New York CNN —The National Labor Relations Board on Wednesday ruled that Home Depot violated the law by firing an employee after he refused to remove “BLM” (which stand for “Black Lives Matter”) messaging from his work apron. The NLRB ruled that Morales’ refusal to remove the messaging was a “protected concerted activity” to protest the racial injustice that took place at the store from August 2020 to February 2021. The Board’s reasoning flips rulings from lower NLRB judges on BLM messaging on employee uniforms in Home Depot and Whole Foods. A change in messagingThe decision by the Labor Board overturned a ruling by an NLRB administrative law judge in 2022. A decision by an administrative law judge can be appealed to the Board, made up of five members.

WASHINGTON (AP) — The Supreme Court on Friday agreed to hear an appeal from Starbucks in a dispute with the National Labor Relations Board over efforts by workers to unionize at a store in Memphis, Tennessee. The case has been among the most closely watched in the more than 2-year-old effort to unionize Starbucks' company-owned U.S. stores. Workers United, the union organizing Starbucks workers, said the company is trying to weaken the labor board's ability to hold companies accountable. “There’s no doubt that Starbucks broke federal law by firing workers in Memphis for joining together in a union,” Workers United said. “The district court determined that, and the decision was affirmed by one of the most conservative courts in the nation.”The Memphis store did eventually vote to unionize.

Starbucks is suing for trademark infringement, demanding that Workers United stop using the name Starbucks Workers United for the branch that is organizing the coffee company's workers. But posts and retweets from local Starbucks Workers United branches supporting Palestinians and condemning Israel were still visible on X Wednesday. Seattle-based Starbucks filed its lawsuit in U.S. District Court for the Southern District of Iowa, noting that Iowa City Starbucks Workers United was among those posting pro-Palestinian messages. In a letter sent to Workers United on Oct. 13, Starbucks demanded that the union stop using its name and similar logo. In its response, Workers United said Starbucks Workers United’s page on X clearly identifies it as a union.

Many farm workers are seasonalBut why does this key employment report only tally “nonfarm” workers? However, despite the “nonfarm” nomenclature, a growing share of farm workers does make it into the BLS job report tally. Historically, the job of counting farm workers falls to the US Department of Agriculture due to its relationships with farms across the country. But farmers aren’t the only workers the jobs report excludes: Elected officials, domestic workers, some members of the clergy and people in many other nontraditional professions are also left behind in the official jobs report data.
